The Latest Revised Anti-Unfair Competition Law of the People's Republic of China Gets Approval
On November 4th, the latest revised Anti-Unfair Competition Law of the People's Republic of China is approved by Standing Committee of the National People's Congress’s vote which will be effective on January 1st, 2018. Anti-Unfair Competition Law of the People's Republic of China is an important law among the law system of China socialist market economy. The purpose to revise this law is to adapt changes of China’s economical and social development and further improve related regulations and rules aiming at new circumstances and problems of unfair competition behaviors which is beneficial to regulate market competition order and protect legal interests of sellers and consumers.
China Mainland and Taiwan to Promote Development of Trade Secret Together
From November 2nd to 3th, 2017 Academic Forum of Trade Secret Protection Between China Mainland and Taiwan was successfully held in Beijing, China. China’s Software Copyright Registrations Increased 96.9 Percent
The Copyright Protection Center of China announced in the early of November that the number of software copyright registrations nationwide in the first nine months of 2017 increased 96.9 percent from the same period last year, a record growth rate for the last five years. In September alone, there were 74,351 registrations, up 90.2 percent year-on-year. Guangdong province topped the nation with 17,455 registrations, followed by Beijing with 16,974.
China’s Gross Expenditure of R&D Reached 1.57 Trillion Yuan in 2016
China's gross expenditure for research and development grew from 1.03 trillion yuan ($156 billion) in 2012 to 1.57 trillion yuan in 2016, with 77.5 percent being spent by enterprises. China also has topped the world for the six consecutive years in patent applications, including 1.34 million in 2016, more than double that in 2012, according to the Ministry of Science and Technology. Those achievements are fueled by a total of 3.81 million science workers, the largest group in the world. Wang Zhigang, vice-minister of Ministry of science and technology, expressed that "Innovation cannot be achieved solely by scientists in ivory towers. It has to be integrated closely with the economy, society, people's livelihood and national security," at the 19th National Congress of the Communist Party of China.
Samsung Phones and Laptops to Face USITC Investigation
The US International Trade Commission (ITC) has agreed to investigate a complaint that Samsung products, including mobile phones, tablets and laptops, have infringed two patents covering semiconductors. On October 31, the?ITC announced it will probe “wafer-level packaging semiconductor devices and products” after a complaint filed by Tessera Advanced Technologies in September. Tessera, which focuses on research and development (R&D) of semiconductor packaging technology, cited two patents in the complaint, saying Samsung had continued using its technology despite a licence having expired. Tessera wants a limited exclusion order and cease-and-desist orders for Samsung’s alleged violations of section 337 of the Tariff Act of 1930. At this stage the ITC has not ruled on the merits of the case, as the complaint will now be handled by an administrative law judge who will make an initial determination.
