A legal report on Chinese e-commerce released by China e-Business Research Center (CECRC) found that of all the legal disputes encountered by e-commerce businesses, 61.54% were associated with intellectual property rights, a proportion much higher than that of other kinds of legal disputes. Among all kinds of intellectual property rights, copyright, patent and trademark are closely related to e-commerce businesses. Intellectual property rights are exclusive and private rights, while information online can always be accessed by everyone, a fact that makes online IP violations more pervasive.
Online information distribution is border free, which makes it more difficult to handle online IP disputes by e-commerce businesses. In addition, there are many other difficulties in dealing with online right disputes, for example, it’s hard to properly identify violators and courts, and evidences are always unavailable, making online disputes an increasingly prominent issue.
