Heilongjiang handed down measures on enhancing intellectual property protection in new emerging industries

As of now, invention patents in force in new emerging industries including high-end equipment manufacturing, biotechnology, new materials and new generation of information technology in Heilongjiang province have merely recorded 3,167, and only a few of enterprises in those industries owned indigenous core patented technologies.

In a bid to promote the capacities of those industries in intellectual property (IP) creation, utilization, protection and administration, the province has recently launched Implementation Opinions on Enhancing Intellectual Property Protection in New Emerging Industries.

According to the Opinions, Heilongjiang will further implement the Outline of Intellectual Property Strategy of Heilongjiang to promote the commercialization and industrialization of patented technologies in those industries. The province plans to cultivate a batch of enterprises holding core patented technologies by 2020.

Intellectual property performance should be considered as one of indicators which are used to evaluate scientific and technological projects. A green path for new emerging industries to obtain patents, trademarks and copyrights should be established and improved.

An IP investment and financing platform should be established to extend channels for enterprises to obtain patent collateralized loans. Meanwhile, the province urged to set up a mechanism on patent transfer.

The Opinions also suggest incorporating intellectual property protection in new emerging industries into local regulations and normative documents to create a favorable political environment. Law enforcement activities should be waged periodically and protection aid systems should be further improved. Talents, in particular, should be fostered by setting up intellectual property related courses in colleges and universities.

Enterprises should be encouraged to file patent applications and trademark registrations outside China to enhance their competitive edge in international market and to strengthen their capacities in safeguarding their rights in foreign countries.

The leading group in charge of the formulation and implementation of intellectual property strategies will coordinate with the Provincial Intellectual Property Office, the Provincial Development and Reform Commission and the Provincial Science and Technology Bureau to establish an effective long-term mechanism on protecting intellectual property rights in new emerging industries, aiming to spur a healthy growth of those industries.
