Two Madrid Agreement’s Declarations Enter Into Force in Oman

MUSCAT - The World Intellectual Property Organization (WIPO) notified the Sultanate of Oman that the two declarations in respect of the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks have entered into force on March 12, 2008.

 

According to a WIPO notification released on November 28, 2008, those declarations deposited by Oman on December 12, 2007; the first is in accordance with Article 5(2) (d) and pursuant to Article 5(2) (b) of the Madrid Protocol (1989), which states that the time limit of one year to exercise the right to notify a refusal of protection referred to in Article 5(2) (a) thereof is replaced by 18 months.

 

While the second declaration in accordance with Article 8(7) (a) of the Madrid Protocol (1989), stipulates that “the Sultanate of Oman, in connection with each international registration in which it is mentioned under Article 3ter of the said Protocol, and in connection with the renewal of any such international registration, wants to receive an individual fee, instead of a share in the revenue produced by the supplementary and complementary fees.”

 

The Government of the Sultanate of Oman deposited on July 16, 2007, its instrument of accession to the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks, adopted at Madrid on June 27, 1989 (Madrid Protocol (1989)). The Madrid Protocol entered into force, with respect to Oman, on October 16, 2007.
