Hainan: Internet cafes leading IPR infringement

According to Hainan Higher People's Court, courts in Hainan Province totally heard 215 IPR civil cases in 2011, 6 times more than that of 2010. IPR infringement was truly identified in most cases. Beijing Netmovie Co., Ltd. alone filed about 120 civil cases involving Internet cafes' violation of the rights to the network dissemination of films and television programs in Hainan last year.

Judges found many Internet cafes in Hainan provided Video-On-Demand services to consumers without receiving a grant of information network dissemination, infringing the legal rights of copyright holders. Some Internet cafe operators ascribed it to right holders, claiming right holders did not protect their own rights. Others kept indifferent to the prosecution and even rejected litigant documents or refused to appear in court. [Chinese version is available on Liaoning Daily]
