In 2011, Chongqing No. 5 Intermediate People's Court received a total of 569 IP disputes, showing a significant increase in number with cases 2.28 times that in 2010, a spokesman of the IP Tribunal of the Court disclosed on the eve of the World Intellectual Property Day.
Enterprises represented by Chongqing Golden Shield IP Agency Co., Ltd. and Beijing Niaoren Art Promotion Co., Ltd. took bulk proceedings in the jurisdiction of the Court. They brought 179 disputes to the Court in 2011, accounting for 40% of newly accepted cases of first distance and leading a commercialization trend in litigation.
Such cases have the following three features. First, the objects being protected are extended from pictures to musical works and animation products (designs) among other related cultural items. Rights-safeguarding in a commercial manner is not a thing newly born. Picture companies such as Getty Images conducted bulk litigations for violations of picture copyright before 2011. Recent years gradually saw a litigation trend in the fields of musical works, animation products and other cultural products. Second, the defendants, generally small KTVs or individual businesses, lack IPR awareness and hold a "free lunch" attitude. Last, defendants are subject to mediation and out-of-court settlement as plaintiffs could win such cases in all probability.
