Mofcom: Exhibitors violating IPR twice to be cleared away from future exhibitions

An IPR complaint handling agency shall be set up during any exhibition that lasts three days or more, prescribed by Measures to Protect Intellectual Property Rights in Exhibitions (Revised Draft) recently passed by China's Ministry of Commerce (Mofcom), as reported from Mofcom on December 29. After receiving complaints from IPR right holders, the agency shall transfer all necessary materials to IPR administrative authorities within 24 hours.

According to the Measures, IPR infringements verified by local IPR administrations shall be tackled with in cooperation with the management department of the exhibition in question. Those that have violated IPR twice or more will be prohibited from participating in the next event by the organizer, which also bears the responsibility to warn of any inadequate IPR protection during the event. [Chinese version is available on legaldaily.com.cn]
