Vice Minister of Commerce:Fiercely combat intellectual property infringement

When interviewed by people.com.cn on August 12, Vice Minister of Commerce Jiang Zengwei illustrated in detail the nationwide crackdown on intellectual property infringement and production and sales of counterfeit or shoddy commodities. As Jiang stated, remarkable results had been achieved during the special campaign, which had a deterrent effect on offenders.

Jiang introduced that the special campaign represented five major characteristics in terms of organization and form.

Strong organization and mobilization

Principal leaders of 22 provinces outlined definite requirements for the special campaign. Each province (municipalities/autonomous regions) set up a special leadership group to put forward working plans. The bottom-up anticipation, harmonized collaboration and clearly-defined liability greatly supported the implementation of the special campaign.

Specific highlights and clearly-defined responsibility

The State Council raised specific requirements for key products, key industries and key areas. Under the deployment of the State Council, the special leadership groups identified 36 issues media followed and the public concerned about. In addition, efforts focused on another 13 tasks effectively restrained IPR infringement and attacked IPR infringing behaviours.

Remarkable results

Law enforcement organs have put 3,430 million yuan worth of 156,000 cases on file; transferred over 1,700 cases to judicial organs; and destroyed 9 thousand illegal sites. In addition, court newly released judicial interpretation of intellectual property laws, tightening the linkage of administrative law enforcement with criminal justice.

Deterrence on the resolution of key cases

Crackdown on crimes was only one part of the special campaign, and more efforts should be addressed to require responsible entities and organs to report to the special leadership group. Different departments spared no time and energy in achieving the expected goal.

Creating a good social atmosphere

In addition, the government disclosed how enterprises conducted restructuring and upgrading to adapt to market economy, how enterprises utilized intellectual property to seek development, and how enterprises maintained their interests in the process of "going-out". Meanwhile, businesses were guided to protect IPR in accordance with IP laws and regulations; and right holders and the public were encouraged to join the special campaign.
