Gansu Launches Special Campaign on Fighting against Counterfeiting Goods

Lately, Gansu issued Program on Special Campaign on Combating IPR Infringement and Manufacture and Sales of Counterfeiting and Shoddy Commodities, which will last from November 2010 to March 2011.

The goal of the special campaign is severely investigating a pile of serious cases, disclosing a group of illegal enterprises and effectively curbing the illegal activities of infringing IPRs and manufacturing and selling counterfeiting commodities by launching such a special campaign. Moreover, the special campaign particularly protects copyrights, trademarks, patents and new plant variety rights. Gansu province will also strictly inspect counterfeiting goods and reinforce price administration to regulate operators’ price actions and curb illegal activities such as price swindling. Furthermore, require all the governmental bodies to use original software and then the large and medium-sized enterprises and operating entities to use genuine software.

According to the requirements of Gansu Provincial People’s Government, public security departments should promptly investigate crimes involving IPR infringement and manufacture and sales of counterfeiting commodities and related bribery in business, especially serious cases concerning IPR infringement. Step up sufficient joint between administrative enforcement and criminal judicature to avoid detaining cases and substituting administrative for legal penalties and firmly hold IPR offenders’ criminal liabilities. The departments including IPR, industry and commerce, news and publications, commerce, taxation, quality supervision and agriculture and animal husbandry should timely transfer cases that meet the standards of criminal prosecution for filing; for cases in which offenders may escape or destroy evidence, the above-mentioned departments should immediately consult and request public security departments to early involve in the investigation. The supervision departments should intensify supervision over the cases transferred by administrative organs. Judicial departments should guide lawyers to well do their agency work in the cases concerning IPR infringement and manufacture and sales of counterfeiting commodities.
