Notice on the Mobilization and Deployment of the Special Campaign on Cracking down upon IPR Infringement and Manufacture and Sales of Counterfeiting and Shoddy Commodities

Provinces, autonomous regions, municipal governments, Xinjiang Production and Construction Corps, offices of ministries and departments directly under the State Council:

To enhance the protection of intellectual property and maintain a fair and ordered market environment, China’s State Council has decided to launch a special campaign nationwide to crack down upon IPR infringement and Manufacture and Sales of Counterfeiting and Shoddy Commodities and has recently issued “Notice of the State Council to Set up a Leading Group for the Special Campaign Nationwide to Crack down upon IPR Infringement and Counterfeiting” (No. 49 [2010]) and “Notice of the State Council to Issue the Implementation Plan for the Special Campaign to Crack down upon IPR Infringement and Manufacture and Sales of Counterfeiting and Shoddy Commodities” (No. 50 [2010]). The Leading Group for the nationwide campaign (with its office set in China’s Ministry of Commerce) has been set up and objectives, tasks, division of labor and requirements of the special campaign have been defined.

The schedule of the special campaign is rather tight and the tasks to be fulfilled are onerous, requiring relevant regional authorities to pay great attention and highlighting the sense of urgency and responsibility. Regional departments shall respectively formulate detailed implementation proposals in accordance with the plan of the special campaign issued by the State Council, clearly identify the tasks and targets, specify the priorities in different industries and aspects and appropriately arrange the schedules. Departments involved shall follow the indication of the teleconference to be held by the State Council (Cabinet) on the nation's intellectual property protection and law enforcement and impel the mobilization, implementation and information promulgation. Meanwhile, regional authorities shall respectively constitute local leading groups that have similar organizational structure to that of the national Leading Group. People in charge in corresponding authorities shall take the lead in the groups and be responsible for the special actions. Regional leading groups shall also set up respective offices and build up a mechanism for effective coordination in law enforcement and information exchange in serious cases. Regulations shall be formulated to regulate practice concerning collecting statistics in law enforcement, supervising serious cases, delivering important information, reporting and promulgating. Departments involved shall nominate a director of department and bureau level as member of the national Leading Group and a division chief as liaison officer.

Please deliver the implementation proposals, organization of the leading groups, contact persons and contact information (including designated members and liaison officers to the national Leading Group) to the national Leading Group for the national campaign before November 10.
