the Peoples Education Press said the well-known trademark was recognized because of the legal procedure taken by authorities such as the Trademark Office of State Administration for Commerce and Industry, the Trademark Appeal Board or people’s courts. It’s said that before the registered trademark of the Peoples Education Press-
“手捧绿芽”(holding the young plant with both hands), there was no precedent for well-known trademark recognition in the book publishing industry.
A pair of hands and a young plant makes up the
“手捧绿芽”trademark. The upward facing hands stands for the hard work of
the Peoples Education Press in holding up the hope of the motherland. The hands combined with the young plant express cultivation and nurturance. It’s said the trademark was being extensively used in many kinds of textbooks and books published by the Peoples Education Press as early as the middle of 1980s. In December, 1997,
“手捧绿芽” gained its recognition by the Trademark Office of State Administration for Commerce and Industry. In 2008, the Peoples Education Press sued a company in the
Foshan Intermediate People's Court for illegal use of “手捧绿芽” on its stationery without permission, and applied for recognition of “手捧绿芽” as a well-known trademark. In February, 2010, the registered trademark “手捧绿芽” was recognized as a well-known trademark by the Foshan Intermediate People's Court. According to the
Trademark Law, the well-known trademark has priority in intellectual property protection over an ordinary registered trademark.
