Cross-strait Cooperation Treaty on the Protection of Intellectual Property Signed

On June 29, Chen Yunlin, the president of the Beijing-based Association for Relations Across the Taiwan Straits (ARATS), and chairman of Taiwan’s Straits Exchange Foundation (SEF) Jiang Bingkun, signed the Cross-strait Cooperation Treaty on the Protection of Intellectual Property in Chongqing.
 
The two sides, based on the principle of equality and mutual benefit, will deepen the cross-strait exchanges and cooperation in IPR protection. The agreement includes patents, trademarks, copyrights and new varieties of plants. The agreement is expected to enhance capability in the creation, application, and management of protection of IPR.
 
The two sides agreed to confirm the validity of the date of filing the first applications on patents, trademarks and new varieties of plants and actively push forward the related arrangement to protect the priority rights of people on both sides. They agreed to accept each other’s applications of new varieties of plants listed in directory of new varieties of plants protection.
 
In addition, the two sides agreed to build a copyright authentication mechanism to promote the across-strait copyright trade. When one side is expected to publish audio-visual products within the other side’s jurisdiction, the products must be submitted to the latter’s assigned associations or communities for copyright certifications. They also exchanged opinions over building authentication mechanism of library, software and other protects.
