EU-China workshop on application of Anti-Monopoly Law in IP

IPR2 is supporting the State Administration for Industry and Commerce (SAIC) to organise a workshop on the implementation of the Anti-Monopoly Law in the IP area with a particular focus on questions related to the abuse of IPR on 11-12 March, 2010 in Changsha, Hunan Province.
The question of borders and limitations of IP protection that ensures fair competition has been debated during the drafting of China's Anti-Monopoly Law. However, the issue is now with the implementing authorities to define.
SAIC is mandated with implementing the Anti-monopoly Law with regard to monopolistic agreements, abuse of market dominant position, and practices to eliminate or restrict competition through abuse of administrative power (excluding price monopoly). This workshop aims to provide local enforcement officials from local AICs with information and best practices on the implementation of competition law in Europe, covering potential conflicts with intellectual property protection as well as the opportunity to share and discuss challenges and experiences.
This is part of a broader cooperation between IPR2 and SAIC on ground level enforcement related to unfair and anti-competitive market behavior.
