Recently, the Haidian Court heard a case in which Baidu Company sued Shenzhen Yiyou Network Technology Co., Ltd. for an unfair competition dispute. It is reported that this is the first case involving "search engine optimization" unfair competition disputes.
On April 20th, the fifth civil trial court (intellectual property court) of the Haidian Court went to Zhongguancun Intellectual Property Protection Center to carry out the itinerant trial of the case and heard the case publicly.
During the trial, under the auspices of the collegiate panel, the plaintiff and the defendant focused on whether the two parties have a competitive relationship, whether Yiyou Company actually implemented the act of clicking on the target website to increase the number of website hits, and whether the act being sued belongs to the behavior which was regulated by the Anti-Unfair Competition Law, as well as the basis and method of calculating the amount of damages, etc., have provided evidence and fully expressed their opinions. The case will be sentenced on another day.
