Recently, China Audio-Video Copyright Association issued the "Announcement on Requirement of Kuaishou APP to Delete 10,000 Suspected Infringing Videos (First Batch)". The Association has commissioned "12426" Copyright Inspection Center to provide the first batch of 10,000 links to suspected infringing videos. Beijing Kuaishou Technology Co., Ltd. must delete suspected infringing videos, stop infringing activities, and self-check the copyright of songs.
In mid-January, the Music Collection Association had filed an "infringement and removal complaint" on the Kuaishou App to the Apple Store and the six major domestic stores. Apple Store officials also responded to an email requesting Kuaishou to resolve the copyright issue with the Association as soon as possible. Otherwise, Kuaishou App Will be removed from the Apple Store.
In November last year, the Association formally filed a complaint with the National Copyright Administration, PRC of Kuaishou's infringement. Simultaneously, the Association filed a case sued Kuaishou for infringing on the rights of the recording producers of five songs including "Hongyan" in Beijing Internet Court on October 12, 2020.
China Audio-Video Copyright Association stated that in recent years, members have continuously reported to the Association the infringement of the use of music recordings on the short video platform. It hopes that the Association will crackdown on infringements and protect the rights of right holders by the law. According to Zhou Yaping, the Association's vice-chairman, so far more than 100 members have successively signed agreements with them, granting the Association the right of reproduction, information network dissemination rights and other rights related to music recording products used by short video APP. To live up to the trust of its members, on the one hand, the Association reports to the National Copyright Administration, PRC and asks for guidance and support; on the other hand, it takes quick action and establishes a short video in conjunction with the "Sword at the Internet campaign" carried out by the National Copyright Administration, PRC to construct the order of copyright licensing in the field of the short video platform.
According to Guo Kun, Deputy Director-General of the Audio Collection Association, short video platforms such as Douyin and Caishi actively responded to the problem. It reached a copyright cooperation plan with the Association an example for the short video industry. However, there are also some platforms represented by Kuaishou evading legal liability, and there are still a staggering number of infringements.
